EB-5 Program Overview
What is the EB-5 Visa Program?
The EB-5 Immigrant Investor Program is a U.S. immigration program
established by Congress to encourage foreign investment and job creation
in the United States. Through this program, eligible investors may pursue
lawful permanent residence by making a qualifying investment in a U.S.
commercial enterprise associated with job creation for U.S. workers.
Under current regulations, EB-5 investments must generally meet several
core program requirements:
- Minimum Investment Amount – The required investment is $1,050,000, or $800,000 for projects located in designated Targeted Employment Areas, which may include certain rural regions.
- Investment at Risk – The capital invested must be placed “at risk” for the purpose of generating a return, consistent with EB-5 program guidelines
- Job Creation Requirement – The investment must be associated with a project that is structured to support the creation of at least 10 full-time jobs for U.S. workers per investor, as defined under program regulations.
Applications are reviewed by U.S. Citizenship and Immigration Services
(USCIS), and eligibility depends on meeting the program’s investment and
job creation criteria as defined under applicable regulations.
